Civil Litigation:

1. Day-to-day carriage of the following matters:

• Acting for the Defendant in a contract dispute matter in the District Court of South Australia.
• Acting for the Defendant in a matter regarding the contravention of s 18 of the Australian Consumer Law.
• Acting for the Plaintiff in a matter to sue the Defendants regarding the contravention of ss 79 and 182 of the Corporations Act and copyright infringement in the Federal Court of Australia.
• Acting for the Plaintiff in a professional negligence matter in the District Court of NSW.

2. Task involves:

• Consider and collect the documents provided by the clients and other parties, prepare a chronology, and brief Counsel.
• Attend conferences with Counsel and clients, and take file notes.
• Draft one Statement of Claim, one Amended Originating Application, Consent Orders, Short Minutes of Orders, one Interlocutory Application and Affidavits.
• Draft letters to other parties.
• Comply with court orders for discovery, consider documents provided by the clients, and prepare lists of documents and accompanying affidavits.
• Prepare a Request for Leave to Issue Subpoena.
• Attend directions and one case management hearing regarding the setting aside of a Subpoena.
• Conduct legal research.

Family Law

1. Day-to-day carriage of the following matters:

• Two family law cases regarding the alteration of property interests of the parties under s 79 of the Family Law Act.
• One family law case regarding a potential dissolution of the marriage under s 23B(1)(a) of the Marriage Act.

2. Task Involves:

• Consider and collect the documents provided by the clients and other parties, prepare a chronology, and brief Counsel.
• Disclose the financial documents to the other party and request documents from the other party.
• Prepare one Confidential Case Outline and one without prejudice Balance Sheet.
• Attend the Conciliation Conference.
• Prepare one trial affidavit.
• Draft correspondences to the other parties and one joint letter to valuers.
• Conduct legal research.

Civil Litigation

• Possess skills in drafting various legal documents, including pleadings, affidavits, letters of demand, letters to the other party, Calderbank offers, and deeds of settlement.
• Advise clients on matters regarding breach of fiduciary duties and assist with the setup and management of Extraordinary General Meetings (EGM) related to the removal and appointment of directors. This involved drafting the notice of EGM, consent to act, appointment of a corporate representative, minutes of the EGM, and a memorandum of the EGM.
• Work closely with barristers and draft briefs to counsel.
• Develop communication skills, hold conferences with clients to seek instructions, and issue letters of advice as required.

Legal Research

• Conduct comprehensive legal research to provide relevant case law and statutes that assist the solicitor in preparing for cases.

Case Management

• Assist the solicitor in reviewing and organizing documents provided by the client.
• Arrange files and ensure the easily accessibility for future reference.
• Request additional information or documents from clients.
• Draft cost agreement.
• Use an outlook calendar to track processes and deadlines.
• Regularly coordinate with the partner for the review and settlement of legal documents.

Client Interactions

• Have conference with clients and obtain instructions.
• Draft file notes after conference with clients.
• Draft court attendance report to clients.

Legal Documents

• Maintain familiarity with NSW Online Registry system and file court documents.
• Draft one affidavit and one defence.
