  • Step 2: Making a decision about the offer of lump sum compensation
  • Following the assessment of permanent impairment, you need to make a decision about the offer of lump sum compensation within 20 business days.
  • If you are assessed as having an OPI of less than 20%, you must make a choice between accepting and seeking damages or your injury. This choice is called an 'irrevocable election'. You cannot choose both nor can you later change your mind.
  • You need to make your decision within 20 business days. You can:
  • 1. Accept the offer. We will then pay your lump sum compensation within 14 days of receiving this form.
  • 2. Reject the offer if you intend seeking damages for negligence against your employer. If you intend to claim for damages without returning this form, you will be taken to have rejected the offer.
  • 3. Defer the offer if you want to make your decision later. If you do not return this form, you will be taken to have deferred a decision about the offer.
